University of Essex Online Terms and Conditions
University of Essex Online courses are validated by the University of Essex and delivered by Kaplan Open Learning (Essex) Limited. All financial transactions relating to University of Essex Online courses are carried out through Kaplan Open Learning (Essex) Limited, Company Registration Number 06245017. The following Terms and Conditions are applicable to any student starting a University of Essex Online course from 01 July 2014 onwards.
1.1. University of Essex Online courses are delivered by Kaplan Open Learning (Essex) Limited, a company registered in England and Wales under company number 006245017 and with a registered office at Ground Floor, Palace House, 3 Cathedral Street, London, SE1 9DE.
1.2. “Full Course Fee” means the total tuition fees payable as published on the University of Essex Online website, subject to the conditions outlined in 4.1.
1.3.“Standard Course Duration” means the standard part-time course duration as published on the University of Essex Online website.
2.1. All applicants must complete an application form and follow the University of Essex Online admissions process.
2.2. Admissions decisions are subject to an academic assessment of an applicant’s education and work experience. Reasons for non-acceptance on a programme will not be disclosed.
2.3. Anyone supplying false documents, false or incomplete information on the application form or in any other communications, verbal or written, is liable to suspension or expulsion from the course.
3.1. Offers of places on a course are made in writing to applicants and accompanied by an acceptance form. To accept a place on a University of Essex Online course, applicants must return a signed copy of the acceptance form.
3.2. Places are subject to availability at the time acceptances are received and cannot be guaranteed.
4.1. Tuition Fees:
4.1.1. All applicable undergraduate course fees are published on the University of Essex Online website and particularised on the following page: http://online.essex.ac.uk/student-finance/undergraduate-tuition-fees
4.1.2. All applicable postgraduate course fees are published on the University of Essex Online website and particularised on the following page: http://online.essex.ac.uk/student-finance/postgraduate-tuition-fees
4.1.3. We reserve the right to make increases to course fees at any time to reflect inflation and changes in available higher education funding.
4.1.4. All students will be charged the published fee per month over the published Standard Course Duration, or the actual course duration, whichever is the shorter. Monthly tuition fees will continue to be payable during study breaks. The total tuition fee charged will not exceed the Full Course Fee as published on the University of Essex Online website, subject to 4.1.3.
4.2. Tuition fee loans:
4.2.1. If undergraduate tuition fees are financed via a government-backed tuition fee loan awarded by Student Finance England, a fully completed loan application must be submitted to University of Essex Online prior to commencement of studies.
4.2.2. University of Essex Online reserves the right to await confirmation of the loan award from Student Finance England before studies can be commenced. If a loan application is rejected by Student Finance England after studies have commenced, students are liable for any fees already incurred. Non-payment will result in withdrawal from the course.
4.2.3. No loan monies will be claimed by University of Essex Online from Student Finance England for students who submit a loan application but do not start a course.
4.3. Tuition fee payment:
4.3.1. If tuition fees are not funded via a tuition fee loan, an initial payment equivalent to one monthly published fee is required prior to commencement of studies. Thereafter, payments are due on the same date each month, based on the original course start date. If a payment is late or not received, studies will be suspended.
4.3.2. Students enrolled on a University of Essex Online programme via Stafford, our student recruitment representative in the Middle East, are bound by the tuition fee payment terms and currency outlined by Stafford at the time of enrolment.
4.4.1. If tuition fees are paid in full up front a 10% Full Payment Discount will be awarded based on the Full Course Fee as advertised on the website.
4.4.2. If applicants have previously completed an undergraduate degree with Kaplan Open Learning, University of Essex Online or the University of Essex a 10% Alumni Discount will be deducted from the monthly tuition fee advertised on the website.
4.4.3. The Full Payment Discount and the Alumni Discount cannot be taken in combination. Only one discount can be applied.
4.5. Credit facilities and additional charges:
4.5.1. Credit facilities are subject to the discretion of University of Essex Online and must be approved in writing prior to course commencement.
4.5.2. Payments must be made in Pound Sterling. Students are responsible for all bank transaction fees charged by the remitting bank.
5.1. Students have the right to cancel their course within 21 days of the course start date stated on the offer letter.
5.2. To cancel a course, students must submit a Course Withdrawal Form which can be downloaded from the online learning platform or requested by emailing email@example.com. If no such form is received, students will be deemed active on the course.
5.3. If students decide to cancel their course within 21 days of the course start date stated on the offer letter, a full refund will be made within 14 days of any monies paid and no loan funds will be claimed from Student Finance England.
5.4. If students are paying their tuition fees via our monthly payment plan and decide to cancel their course after 21 days of the course start date stated on the offer letter, no refund will be made and no further fees will be incurred from date of cancellation.
5.5. If students have paid their tuition fees up front, taking advantage of our 10% Full Payment Discount, and decide to cancel their course after 21 days of the course start date stated on the offer letter, they will be charged the full monthly tuition fee as advertised (without applying the 10% discount) for each month of study commenced and a refund will be made for the remainder.
5.6 If students have applied for a tuition fee loan from Student Finance England, the first installment of their loan will be claimed 21 days after the course start date and is non-refundable. Subsequent installments will be claimed from Student Finance England in accordance with paragraph 4.1.4. Students will be liable to repay the loan in accordance with Student Finance England's terms and conditions.
5.7 If Students enrol on a University of Essex Online programme via Stafford, our student recruitment representatives in the Middle East, and decide to cancel their course within 21 days of the course start date stated on the offer letter, they will receive a full refund less an enrolment fee of $500 (students enrolled on CertCE programmes are exempt from the enrolment fee).
5.8 If Students enrol on a University of Essex Online programme via Stafford, our student recruitment representatives in the Middle East, and decide to cancel their course after 21 days of the course start date stated on the offer letter, no refund will be made and no further fees will be incurred from the date of cancellation.
6.1. University of Essex Online reserves the right to:
6.1.1. Cancel any course prior to the published start date of the course, in which case an alternative start date or full refund will be offered.
6.1.2. Withdraw courses, levels and/or modules at any time if for any reason the course is not viable. In these circumstances University of Essex Online will use reasonable endeavours to make appropriate arrangements for continuation of studies.
6.1.3. Withdraw students from their studies for academic reasons as stated in the Rules of Assessment.
7.1. If APL is awarded the Standard Course Duration and Total Tuition Fees will be reduced proportionately.
8.1 Computer equipment and internet access costs are not included in our course fees and are the responsibility of students.
9.1. Students must not make their online passwords available to any third parties. Courses are not transferable between students.
9.2. University of Essex Online reserve the right to require students to leave the course (without a refund) at any stage if students are in breach of any of University of Essex Online academic or other policies, are guilty of inappropriate conduct or behaviour or of acting, in our view, in any way which detrimentally affects the learning experience of others or other circumstances apply which University of Essex Online deem unacceptable.
10.1. The rate of study must be a minimum of 30 credits and a maximum of 120 credits in any year of study.
10.2. Courses must be completed within the maximum periods of study outlined in the Rules of Assessment.
11.1. Students agree to be bound by University of Essex Online rules and University of Essex rules relating to conduct, plagiarism, attendance, academic appeals and others detailed at induction and available on the learning platform.
12.1. While University of Essex Online endeavour to ensure that the information on the University of Essex Online website is correct, we do not warrant the accuracy and completeness of the material on the site or in our prospectus.
12.3. The material on the site is provided “as is,” without any conditions, warranties, or other terms of any kind. Accordingly, to the maximum extent permitted by law, the University of Essex Online site is provided on the basis that University of Essex Online exclude all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill) which but for this legal notice might have effect in relation to the University of Essex Online site.
12.4. University of Essex Online and any of our group companies, and their officers, directors, employees, shareholders or agents of any kind, exclude all liability and responsibility for any amount or kind of loss or damage that may result to students or any third party (including, without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the University of Essex Online site in any way or in connection with the use, inability to use or the results of use of the University of Essex Online site, any websites linked to the University of Essex Online site, or the material on such websites, including, but not limited to, loss or damage due to viruses that may infect computer equipment, software, data, or other property on account of access to, use of, or browsing the University of Essex Online site or downloading of any material from the University of Essex Online site or any websites linked to the University of Essex Online site. If your use of the material on the University of Essex Online site results in the need for servicing, repair or correction of equipment, software, or data, you assume all costs thereof.
12.5. Nothing in this legal notice shall exclude or limit our liability for: (a) death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977); or (b) fraud; or (c) any liability that cannot be excluded or limited under applicable law.
13.1. No variation to these terms and conditions will be valid unless agreed in writing by University of Essex Online, provided always that University of Essex Online reserve the right to make any addition, amendment or alteration to these terms and conditions upon giving one module’s written notice of such change to all affected students.
13.2. University of Essex Online may also, by written notice, vary terms and conditions of enrolment with immediate effect as may be necessary to comply with any law or funding regulations.
14.1 Students’ arrangements with University of Essex Online are governed by English law.
16.1. In signing the application form students declare that the information supplied on the form is complete and correct and that the giving of false or incomplete information may lead to the refusal of application or cancellation of enrolment.
16.2. Students give permission for University of Essex Online to obtain official records from any educational institution attended by them and authorise University of Essex Online to supply any relevant official records to the University of Essex and to government bodies.
