University of Essex Online Refer a Friend Terms and Conditions

Effective Thursday 1st June 2017

1. These Terms

1.1. The refer a friend policy is offered by Kaplan Open Learning (Essex) Limited, an affiliate college of the University of Essex, trading as University of Essex Online.

2. Purpose

2.1. To offer tuition fee reductions or payments (“Incentives”) to encourage students who are currently studying a University of Essex Online course, or have previously studied a University of Essex Online course and graduated or received a certificate of completion, or employers funding an existing or previous student on a University of Essex Online course to identify prospective students who may be interested in studying with University of Essex Online.

3. Classification

3.1. “Advocate” is the term used for a person who refers a friend, colleague or family member (“Friend”) to University of Essex Online. “Employer Advocate” is the term used for an employer funding an existing or previous student on a University of Essex Online course who refers an employee (“Friend”) to University of Essex Online. “Referral” is the term used for the act of referring a Friend to University of Essex Online.

4. Advocate

4.1. An Advocate can be an existing student who is currently studying a University of Essex Online course, or a previous student who has studied a University of Essex Online course.

4.2. For the Advocate to qualify for an Incentive in relation to a Referral, the Advocate must meet the following criteria:

a) The Advocate must currently be enrolled on a University of Essex Online course, be a graduate or have received a certificate of completion following the successful study of a University of Essex Online course.
b) The Advocate must have passed the 21-day Cancellation Period.
c) The Advocate must have their Friend’s consent before providing us with their details.

4.3 For the Employer Advocate to qualify for an Incentive in relation to a Referral, the Employer Advocate must have funded an existing or previous student on a University of Essex Online course who has passed the 21-day Cancellation Period.

5. Friend

5.1. A Friend can be a friend, colleague or family member of the Advocate. A Friend can be an employee of the Employer Advocate.

5.2. For the Advocate to qualify for an Incentive, the Friend must meet all of the following criteria:

a) The Friend must not currently be, or previously have been, enrolled on a University of Essex Online course.
b) The Friend must enrol on a University of Essex Online course within 12 months from the date of the referral.
c) The Friend must not already have submitted an application form prior to the date of referral.
d) The Friend must have passed their first module and must not have any outstanding tuition fee payments due.

6. Referral process

6.1. To refer a Friend, Advocates and Employer Advocates must do so via the online referral form found at https://online.essex.ac.uk/students/refer-a-friend/

7. The Incentive

7.1. If the Advocate is currently enrolled on a University of Essex Online course, the Incentive will represent a £500 GBP tuition fee reduction or refund awarded to the Advocate once the Friend successfully passes their first module and the grade has been ratified at one of our quarterly exam boards. The Incentive will be applied in one of the following ways:

(a) If the Advocate has paid their full course fee up front the Incentive will be paid via BACS transfer within 14 days.
(b) If the Advocate has paid their annual tuition fee up front, the Incentive will be credited to the Advocate’s student account and discounted off next year’s annual tuition fee. If the Advocate is in their final year of study, the incentive will be paid via BACS transfer within 14 days.
(c) If the Advocate is paying their annual tuition fee in 12 monthly instalments, the Incentive will be credited to the Advocate’s student account and discounted off next year’s annual tuition fee. If the Advocate is in their final year of study, the Incentive will be credited to the Advocate’s account thus reducing the remaining tuition fee due. The number of monthly instalments due and the final instalment amount will be adjusted accordingly. If the incentive is greater than the remaining tuition fee balance due, the difference will be paid to the Advocate via BACS transfer within 14 days.
(d) If the Advocate is funding their studies via an undergraduate tuition fee loan from the Student Loan Company (SLC), the Incentive will be credited to the Advocate’s student account and discounted off their final year’s annual tuition fee and will be offset against the final loan instalment drawn down from the SLC.
(e) If the Advocate subsequently withdraws or is withdrawn prior to completion of their course, the Incentive will be held on the Advocate’s student account for a maximum period of 12 months from the withdrawal date, after which time the Incentive will no longer be available.

7.2. If the Advocate is a graduate or has received a certificate of completion following the successful study of a University of Essex Online course, the Incentive will represent a £500 GBP payment awarded to the Advocate once the Friend successfully passes their first module and the grade has been ratified at one of our quarterly exam boards. The Incentive will be paid via BACS transfer within 14 days. If the Advocate has an outstanding balance on their account, the Incentive will be offset against the balance due and the difference will be paid via BACS transfer within 14 days.

7.3  If the Employer Advocate is an employer funding an existing, or has funded a previous, student on a University of Essex Online course, the Incentive will represent a £500 GBP tuition fee reduction which will be offset against the Friend’s tuition fees due.

7.4. University of Essex Online will not offer any other form of compensation in place of an Incentive.

8. Non Eligible

8.1. Employees of University of Essex Online, University of Essex and Kaplan (including associate lecturers) and their relatives are prohibited from participation as Advocates, Employer Advocates or Friends.

8.2. Advocates, Employer Advocates and Friends who are employed by an organisation with whom University of Essex Online has a corporate partnership are also excluded from participation.

9. False Information

9.1. Any party making false or misleading statements that result in misuse or misinterpretation of the product, benefits or features provided by University of Essex Online will be cause for an immediate cancellation of, or ineligibility for, the Incentives offered under this agreement.

10. Termination

10.1. University of Essex Online reserves the right to terminate the refer a friend policy at any time. If a Friend meets the requirements of the policy after it has been terminated, the terms of the policy outlined in this document will not apply.

10.2. University of Essex Online reserves the right to limit, reject, or cancel referrals involving an Advocate, Employer Advocate or Friend who disregards these terms and conditions.
