By submitting your entry for the Alan Jenkins Memorial Award (“the Award”) to University of Essex Online (“Kaplan Open Learning”, “KOL”, “UoEO”, “we”), you agree to be bound by these terms and conditions (“Submission Terms”).

Eligibility and entry

  1. You are eligible to submit an entry for the Alan Jenkins Memorial Award 2024 if you meet all of the following criteria:
    • you are studying/have studied a full Bachelors (level 6) or Masters (level 7) degree with UoEO
    • you are eligible to attend Graduation 2024
    • you are aged 18 and over
    • you have not previously been the recipient of the Alan Jenkins Memorial Award
  2. Employees or agencies of Kaplan Open Learning or University of Essex Online, its group companies or their family members, or anyone else connected with the Award, may not enter the Award.
  3. To submit an entry for the Award you must complete this form with your details and your inspirational story.
  4. The closing date for submissions is 09:00am British Summer Time (BST) on 11 June 2024.  Entries received outside this time period will not be eligible for consideration.
  5. Only one entry is permitted per person. Entries submitted on behalf of another person will not be accepted and joint submissions are not allowed.
  6. KOL / UoEO accepts no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.

Award recipient selection

  1. The Award recipient will be chosen at the discretion of an impartial panel at University of Essex Online.

The prize

  1. The Award recipient will receive a trophy, a certificate, and a £500 prize paid by bank transfer.
  2. We accept no responsibility for any costs associated with the prize and not specifically included in the prize.
  3. The Award recipient will be notified by email on or before 30 June 2024. If the recipient rejects their prize or the entry is invalid or in breach of these Terms and Conditions, the Award will be forfeited.
  4. The Award recipient will be required to withhold the news they have won with any fellow students, or post any information about this on their social media until the official announcement has been publicly made by the University of Essex Online.
  5. The prizes will be posted to the Award recipient at an agreed address.
  6. The prizes are non-exchangeable, non-transferable, and are not redeemable for any other prizes.
  7. KOL / UoEO retain the right to substitute the prizes with other prizes of similar value in the event the original prizes offered are not available.

Winner’s video speech

  1. The Award recipient will be required to record and provide a short video speech that UoEO will use for promotional and marketing purposes as stated in point 16. The video must be provided to UoEO by 4 July 2024.

Your rights

  1. The competition and these terms and conditions will be governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
  2. By submitting your entry you hereby grant University of Essex Online a worldwide, non-exclusive, irrevocable, perpetual, sub-licensable, transferable, royalty-free, and fully paid-up right and license to use, copy, adapt, modify, distribute, transmit, stream, broadcast, publicly perform, reference, store, cache, license, sell, transfer and otherwise exploit (including through its distribution channels) the submission content for promotional and marketing purposes.
  3. To the extent permissible under relevant laws, you waive any moral rights in the submission content. You also waive any right to inspect or approve the submission content or printed or electronic matter that may be used in conjunction with such content now or in the future and you waive any right to royalties or other compensation arising from or related to the use of the submission content.
  4. You grant University of Essex Online the right to use your name and course name in connection with the submission content. UoEO will have no obligation to use your name or credit you in any way in its use of the submission content.
  5. You hereby make all warranties, representations and guarantees with respect to the submission content that you make with respect to Content as defined in the Terms of Service, including but not limited to a representation and warranty that the submission content does not infringe or violate the intellectual property rights or proprietary rights, rights of publicity or privacy, or other rights of any third party.
  6. By submitting an entry, you represent and warrant that you have full power and authority to agree to these Submission Terms, including without limitation the power and authority to grant all rights and licenses relating to the submission content. It is at the discretion of University of Essex Online to decide whether and how to use the submission content. University of Essex Online claims no ownership of your submission content.
  7. We shall use and take care of any personal information you supply in accordance with data protection legislation and our Privacy Policy.
  8. We accept no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering a submission for the Award. KOL / UoEO further disclaims liability for any injury or damage to your or any other person’s computer relating to or resulting from participation in or downloading any materials in connection with the Award. Nothing in these Terms and Conditions shall exclude the liability of KOL / UoEO for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
  9. We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Award with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of KOL / UoEO in all matters under its control is final and binding and no correspondence will be entered into.
